2. Description of service

Tokay provides a platform-as-a-service for deploying and managing applications. We handle infrastructure provisioning, deployments, and monitoring while you focus on writing code.

3. User accounts

You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and complete information

4. Acceptable use

You agree not to use our services to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Distribute malware or malicious code
• Engage in cryptocurrency mining
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services

5. Service availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of our services at any time. We are currently in Alpha and the service is provided as-is without warranties.

6. Content and data

You retain all rights to the code and content you deploy through our platform. You grant us the right to host, store, and process your content solely for the purpose of providing our services.

7. Billing and payment

During our Alpha phase, services are provided free of charge. When we introduce paid plans, we will provide advance notice and updated terms. You agree to pay all fees associated with your use of paid services.

8. Termination

We may suspend or terminate your access to our services at any time for violations of these terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the services will immediately cease.

9. Limitation of liability

To the maximum extent permitted by law, Tokay shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. During the Alpha phase, services are provided "as is" without any warranties.

10. Indemnification

You agree to indemnify and hold Tokay harmless from any claims, damages, or expenses arising from your use of our services or violation of these terms.

11. Changes to terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by email or through our service. Your continued use of our services after changes constitutes acceptance of the new terms.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tokay operates, without regard to conflict of law principles.
